Your logic is flawed. Your seem to think that the CHRS: kludge advertises the capabilities of the editor. That is wrong. It does NOT advertise what the editor can do. It says nothing at all about HOW and by WHAT the message was created. All it says how it is /encoded/.
And since UTF-8 is a multi byte encoding scheme, the level is 4.

Indeed, the FTSC is not going to do anything about. The FTSC has done its job by documenting the issue in FTS-5003. Her job is done. The FTSC is not an enforcement body.
