Scanning just the first three bytes is easier than hunting through the text until you either find a well formed UTF-8 string or one that is not well formed.
Wether a BOM is desirable in Fidonet messages or not, is a matter of opinion. The Unicode standard however allows it, that is not subject to opinion.

That is not going to happen. The CHRS kludge and its level parameter have been current practice for almost two decades. Even if present software does not need the level parameter any more, there is no added value in ditching it and risking breaking older software.
