Well, I see your point there, but it could also be argued that the pass/fail vote for a piece of legislation is "electing" to put into place a new law (or not).
So, here's a better example. A couple of months ago, the U.S. House elected a new Speaker of the House. Since you're an expert on the USA, I'm sure you know this already, but it's a pretty important position. So that *ELECTION* was also done on nationwide television, and the voters had to audibly shout out their choice/vote, as a roll call. Most certainly a democratic election, where the votes are cast in the open for all to see.
