10.4 Ausfuehrungsbestimmungen zur RC-Wahl in R24

10.4.1 Durchfuehrung der Wahl

Die Wahl des RC erfolgt in allgemeiner, freier, gleicher, unmittelbarer und geheimer Wahl durch die Nodes der R24.

Die Vorschriften, die fuer NC-Wahlen gelten (Abschnitt 10.3 dieser Policy), finden insoweit auch fuer die RC-Wahl Anwendung, als hier nicht ausdruecklich andere Regeln beschrieben sind.

10.4.2 Wahlleiter der RC-Wahl

Der ZC2 ernennt auf Vorschlag des amtierenden RC24 einen Wahlleiter. Dieser muss Node der Region 24 sein und darf nicht selbst bei der anstehenden Wahl kandidieren.
> The ZC2 appoints a returning officer ("RO") on recommendation of the > incumbent RC24. The RO must be a R24 node, and may not stand as a > candidate in the coming election.
Rechte und Pflichten eines Wahlleiters sowie technische Voraussetzungen fuer die Uebernahme dieses Amtes ergeben sich aus Abschnitt 10.3 dieser Policy.
> The rights and duties of a RO, and the technical requirements for > assuming this office, derive from Section 10.3 of this policy.
Lehnen binnen 2 Wochen mindestens 10 % der wahlberechtigten Nodes oder mindestens 10 % der NCs die Person des Wahlleiters ab, so ernennt der ZC2 einen neuen Wahlleiter; andernfalls gilt er als anerkannt und uebernimmt die weitere Organisation der Wahl.
> If at least 10 % of the franchised nodes or at least 10 % of the NCs > reject the returning officer within two weeks, the ZC2 appoints a new > returning officer; the RO is otherwise considered recognized, and > assumes the further election organization.
Bezueglich der Wahlbenachrichtigung per Netmail (vgl. 10.3.5.2) ist es bei der RC-Wahl ausreichend, lediglich die NCs der Netze - nicht alle Nodes einzeln - von der Wahl etc. in Kenntnis zu setzen.
> In the case of the RC election, it is sufficient to notify only the NCs > of the nets rather than all individual nodes of election-related topics > by netmail (cf. Section 10.3.5.2).
Die NCs muessen den Wahlleiter in einer Weise unterstuetzen, die die reibungs- lose Durchfuehrung der Wahl ermoeglicht.
> The NCs must support the returning officer in a manner enabling smooth > implementation of the election.
Alle offiziellen Mitteilungen des Wahlleiters, die sie per Netmail erhalten, muessen sie per Netmail (ggf. zusaetzlich per Echomail) allen wahlberechtigten Nodes des jeweiligen Netzes zugaenglich machen.
> They must make all official announcements they receive by netmail from > the returning officer available to all franchised nodes of the pertinent > net by netmail, and if appropriate by echomail as well.
Darueber hinaus hat der Wahlleiter selbst seine offiziellen Verlautbarungen in einem dafuer geeigneten regionsweit verfuegbaren Echo (z.Zt. NODE_ORG.024) zu veroeffentlichen.

Der Wahlleiter informiert den ZC2 ueber die Wahlfristen, die Kandidaten, das Wahlergebnis und eventuelle Einsprueche, und stellt ihm auf Anforderung saemtliche Wahlmails zur Verfuegung.

10.4.3 Der Wahlkontrolleur

Vom RC wird in Abstimmung mit dem ZC eine Person benannt, die als Kontrolleur dem Wahlleiter zur Seite gestellt wird.

Rechte und Pflichten des Wahlkontrolleurs ergeben sich aus Abschnitt 10.3.2.

10.4.4 Temporaere Listung

Steht der Gewinner der Wahl zweifelsfrei fest, so wird er fuer eine Einspruchsfrist von 14 Tagen temporaer gelistet.
> If the winner of the election has been unequivocally established, he/she > is listed on an interim basis for a 14-day challenge period.
In dieser Zeit darf er ausser der Erstellung und Weitergabe des Regionfiles keine weitergehenden Pflichten des RC24 uebernehmen, sofern dies technische Probleme nicht zwingend erfordern.
> During this period, he/she may not assume any responsibilities of RC24 > which go beyond compilation and distribution of the region file unless > technical problems absolutely demand action.
In dieser Zeit eingehende Complaints werden aufgeschoben; der Eingang ist fristwahrend.
> Action on complaints filed during this period will be deferred; > applicable deadlines are met upon receipt of the complaint.
Diese 14-taegige Frist ist vom scheidenden und neuen RC sowie den NCs der Region dazu zu nutzen, notwendige Anpassungen an ihrem System vorzunehmen.
> This 14-day period shall be used by the departing RC, the RC-elect and > the NCs of the region to perform required system changes.
10.4.5 Uebergabe der Amtsgeschaefte

Die Uebernahme/Uebergabe der Amtsgeschaefte zwischen altem und neuem RC muss zuegig erfolgen; in jedem Fall ist der ZC2 von der vollzogenen Uebergabe so rechtzeitig in Kenntnis zu setzen, dass er die notwendigen Anpassungen an seinem System vornehmen kann, ohne dass es zu Stoerungen (z.B. Nicht-Annahme des R24-Segmentes wegen Passwort-Fehler) kommt.

Der RC 24 kann jederzeit von den Nodes oder NCs der Region abgewaehlt werden, bevor seine regulaere Amtszeit beendet ist.

Abwahlen finden durch komplette vorgezogene Neuwahl eines Nachfolgers gemaess Abschnitt 10.4.1 bis 10.4.6 dieser Policy statt (konstruktive Neuwahl).
> Removal by vote takes place by means of complete premature election of a > successor as described in Sections 10.4.1 to 10.4.6 of this policy > (constructive new election).
Um eine vorgezogene Neuwahl einzuleiten, ist die schriftliche Zustimmung von 1/5 der stimmberechtigten Nodes der Region oder von 1/3 der NCs der gelisteten Netze erforderlich. Darueber hinaus muss zusaetzlich mindestens ein Kandidat benannt werden, der verbindlich bereit ist, sich zur Wahl als RC zu stellen.
> Written agreement by one-fifth of the franchised nodes in the region, > or of one-third of the NCs of the listed nets required to initiate a > premature election. In addition, at least one node definitely willing to > stand as an RC candidate in the election must be named.
Auch bei vorzeitiger Amtsniederlegung des RC oder bei Amtsenthebung wegen Nichterfuellung der Amtspflichten wird eine vorgezogene Neuwahl faellig.
> A premature election is also necessary if the RC resigns before the > end of his/her term, or is removed from office because of dereliction of > official duties.
Bei der vorgezogenen Neuwahl kann der momentane Amtsinhaber ebenfalls wieder kandidieren.

Solange die vorgezogene Neuwahl nicht abgeschlossen ist, darf der amtierende RC keine Aktivitaeten unternehmen, die das Verfahren in irgendeiner Weise behindern. Er darf keine nur schwer rueckgaengig zu machende Fakten schaffen. Saemtliche von ihm durchgefuehrten sonstigen Aktivitaeten waehrend der Wahl sind bis zu deren Abschluss als vorlaeufig zu betrachten.
> The incumbent RC may not undertake any activities that could impede the > election in any manner during the time the premature election is in > progress. He/she may not make decisions which could only be reversed > with difficulty.
