Der Wahlleiter benennt in seiner Wahlankuendigung diejenige Nodeliste, die zur Ermittlung der Wahlberechtigten zugrundegelegt wird.
> In the election announcement, the returning officer designates the > nodelist used to define the electorate.
Es darf sich um die zum Zeitpunkt der offiziellen Wahlankuendigung aktuelle Nodeliste oder um eine hoechstens 2 Wochen aeltere handeln.
> This must represent the nodelist current at the time of the official > election announcement, or one no more than two weeks older.
Wahlberechtigt ist, wer in der vom Wahlleiter benannten Nodeliste im Netz- segment des betreffenden Netzes gelistet und nicht PVT oder DOWN gekenn- zeichnet ist. Nodes, die in der o.g. Nodeliste HOLD gelistet sind, koennen dann waehlen, wenn sie vor Beginn der eigentlichen Abstimmung wieder regulaer gelistet werden.

10.3.3.2 Multiline-Systeme

Die Wahl wird nach dem Grundsatz "ein Nodesysop - eine Stimme" abgehalten, unabhaengig von der Anzahl der Node-Eintraege, die ein Sysop in einem Netz fuehrt.

Multiline-Systeme haben bei Wahlen nur eine Stimme, es sei denn, auf den verschiedenen Lines eines Systemes sind unterschiedliche Sysops aufgefuehrt.
> Unless different sysops are listed for various lines of the system, > multiline systems have only one vote in elections.
{Die Listung verschiedener Sysops auf den Lines eines Multiline-Systems setzt voraus, dass sie eigenstaendig ihr System betreuen. Die Feststellung, ob ein eigenstaendig betreutes System vorliegt, faellt der NC bei der Listung.}

10.3.4 Kandidaten

10.3.4.1 Voraussetzungen fuer eine Kandidatur

Kandidaten muessen in der vom Wahlleiter in der Wahlankuendigung festgelegten FidoNet-Nodeliste gelistet sein (vgl. 10.3.3.1).
> Candidates must be listed in the FidoNet nodelist named by the returning > officer in the election announcement (cf. Sction 10.3.3.1).
Jeder dort gelistete Node des Netzes kann sich zur Wahl stellen. Ausgenommen sind Personen, die in dieser Nodeliste nur PVT-Eintraege im entsprechenden Netzsegment haben oder DOWN gelistet sind.
> Every node who appears in that list may become a candidate. Exceptions > to this rule are persons with only PVT entries in the pertinent network > segment of that nodelist, or whose system(s) is/are marked DOWN.
Nodes, die in dieser Nodeliste HOLD gelistet sind, koennen dann kandidieren, wenn sie vor Ablauf des Bewerbungszeitraumes fuer die Kandidatur wieder regulaer gelistet werden (vgl. 10.3.5.1).

Kandidaten unterrichten den Wahlleiter innerhalb des festgelegten Zeitraumes von ihrer Absicht zu kandidieren.

Ein Wahlprogramm oder eine Absichtserklaerung kann - muss jedoch nicht - beigefuegt werden.

Der Wahlleiter veroeffentlicht alle Bewerbungen zeitgerecht im festgelegten Echo (vgl. 10.3.5.2); darueberhinaus informiert er alle Wahlberechtigten per Netmail.
> The retuning officer publishes all candidate applications at the > appropriate time in the designated echo (cf. Section 10.3.5.2); he/she > additionally informs all franchised nodes by netmail.
10.3.4.2 Wahlmoeglichkeit "Enthaltung"
> 10.3.4.2 "Abstention" as a vote
Bei jeder Wahl ist die Moeglichkeit zu geben, fuer "Enthaltung" zu stimmen; sie ist kein Kandidat im Sinne der nachfolgenden Regelungen.
> Every election must include the possibility to "abstain"; this choice > does not represent a "candidate" in the sense of the rules below.
Sollte die Wahlmoeglichkeit "Enthaltung" im ersten Wahlgang die absolute Mehrheit der abgegebenen Stimmen erhalten, so ist die Wahl komplett zu wiederholen, das heisst mit der erneuten Kandidatensuche zu beginnen.
> If the absolute majority votes to "abstain" on the first ballot, the > election must be completely repeated, i.e. a new search for candidates > started.
Sollte auch bei einer kompletten Wiederholung der Wahl "Enthaltung" die absolute Mehrheit der Stimmen bekommen, so setzt der RC24 einen NC seiner Wahl ein; dieser muss Node des betreffenden Netzes sein.
> If the absolte majority still vote to "abstain" even after a > complete rerun of the election, the RC24 appoints an NC of his/her > choice; this person must be a node of the pertinent network.
10.3.4.3 Einsetzen des NCs, NC-Vertreter, Temporaerer NC

Eine Einsetzung des NCs durch den RC erfolgt ausser im unter 10.3.4.2 genannten Fall auch dann, wenn

- "Enthaltung" die einfache Mehrheit im zweiten Wahlgang erringt (vgl. 10.3.7.2), - nach einer Stichwahl der NC noch immer nicht feststeht (vgl. 10.3.7.3), - oder sich kein Kandidat fuer das NC-Amt findet (vgl. dazu 10.3.10).
> - a simple majority of votes in the second ballot is for "abstention" > (cf. Section 10.3.7.2); > - no NC has been decided on even after a runoff election (cf. Section > 10.3.7.3); > - there is no candidate for the office of NC (cf. Section 10.3.10).
Kann der amtierende NC voruebergehend sein Amt nicht ausueben (z.B. durch Krankheit, Urlaub), so ist von ihm ein Vertreter zu benennen. Die Zustimmung des RCs zur Person des Vertreters ist erforderlich. Ist der NC selbst zur Benennung eines geeigneten Vertreters nicht in der Lage, so setzt der RC einen Node des betreffenden Netzes als Vertreter des NCs ein.
> If the incumbent NC is temporarily unable to carry out his/her official > duties (e.g. due to sickness or vacation), he/she must name a > substitute. The RC's agreement to the person of the substitute is > required. If the NC him/herself is unable to name a qualified > substitute, the RC appoints a node of the pertinent network as the NC's > substitute.
Der Vertreter des NCs darf hoechstens fuer eine Dauer von 2 Monaten amtieren und lediglich die Compilierung des Networkfiles vornehmen.
> The NC substitute may hold office for a maximum period of two months, > and is only authorized to compile the network file.
Sobald abzusehen ist, dass der urspruengliche NC sein Amt nicht mehr aufnehmen kann oder will, setzt der RC einen "Temporaeren NC" ein; in diesem Fall beauftragt der RC umgehend einen Wahlleiter mit der vorgezogenen Neuwahl des NC (vgl. 10.3.1 f.). Dies gilt ebenfalls fuer den Fall einer Amtsenthebung des NC wegen eines "Administrative Offence" (vgl. 7.1.3).
> If it becomes clear that the original NC is unable or unwilling to > resume his/her official duties, the RC appoints a "temporary NC". In > this case, the RC commissions a returning officer with election of a new > NC (cf. Section 10.3.1 f.). This similarly applies in case the NC has > been removed from office for an "Administrative Offence" (cf. Section > 7.1.3).
Der Temporaere NC bleibt bis zum vollstaendigen Abschluss des Wahlverfahrens im Amt.

Ueber die Compilierung des Networkfiles hinausgehende Rechte - z.B. Bearbeitung von Complaints - erhaelt ein Temp-NC stets nur nach ausdruecklicher Genehmigung durch den RC.

10.3.5 Ablauf der NC-Wahl

10.3.5.1 Grundsaetzliches

Die Wahlen sind stets allgemein, frei, gleich, unmittelbar und geheim (vgl. 10.5 - Glossar).

Wahlen finden ausserhalb der Haupturlaubszeiten (Juni - September) statt, ausser bei wichtigen Gruenden, die gegenueber dem RC24 zu rechtfertigen sind.
> Elections are held outside the main vacation period (June - Semptember) > except when important reasons exist for doing otherwise; these must be > justified to the RC.
Die Wahl beginnt mit der Einsetzung des Wahlleiters.
> The election begins with appointment of the returning officer.
Sie endet, wenn - der Wahlsieger bekannt ist - der RC einen NC eingesetzt hat (10.3.4.3) - das Netz aufgeloest worden ist (10.3.10).
> It ends when > - the winner of the election is known > - the RC has appointed a NC (Section 10.3.4.3) > - the network has been dissolved (Section 10.3.10)
In den ersten 2 Wochen koennen die Kandidaten ihre Bewerbung einreichen und ihr Programm vorstellen.
> The candidates may submit their applications and present their programs > during the first two weeks.
Die folgenden 2 Wochen dienen der Befragung der Kandidaten, und weitere 2 Wochen dienen der Stimmabgabe.
> The following two weeks are used to question the candidates, and a > further > two-week is dediicated to voting.
10.3.5.2 Benachrichtigung der wahlberechtigten Nodes
> 10.3.5.2 Notification of franchised nodes
Der Wahlleiter benachrichtigt alle wahlberechtigten Nodes des Netzes rechtzeitig vor der eigentlichen Abstimmung per Netmail von der Wahl, den Wahlterminen, dem Wahlrecht, der Moeglichkeit der Kandidatur, seiner Funktion als Wahlleiter und der Person des Wahlkontrolleurs.
> Prior to the actual vote and in good time, the returning officer > notifies all franchised nodes of the network by netmail of the election, > the election dates, right to vote and hold office, the possibility of > filing as a candidate, his/her function as a returning officer and the > person acting as election supervisor.
Abhaengig von den anfallenden Kosten kann dies auch als geroutete Netmail geschehen, obwohl crash/direct Netmail vorzuziehen ist.
> Depending on the incurred expense, this may also be accomplished using > routed netmail, although crash/direct netmail is preferred.
Ein "bombing run" zu diesem Zweck wird dann nicht als annoying angesehen, wenn er direkt ueber den Host des waehlenden Netzes geroutet wird. Dazu stimmt sich der Wahlleiter zuvor mit dem Host ab.
> A "bombing run" performed for this reason will not be considered > annoying if routed directly via the host of the voting network. The > returning officer coordinates this action with the host in advance.
Ein spezielles Echo kann aus Anlass einer Wahl eingerichtet und auch vom Wahlleiter fuer Informationen genutzt werden; die Pflicht, alle Wahlberech- tigten per Netmail ueber wichtige Details der Wahl zu informieren, bleibt davon aber unberuehrt.
> A special echo may be created for an election, and may also be used by > the returning officer to provide information; this does not abridge the > obligation to inform all franchised nodes on important election details > of the election by netmail.
10.3.5.3 Stimmabgabe

Alle Stimmabgaben muessen auf das System des Wahlleiters erfolgen. Stimm-Mails muessen unmittelbar und direkt an das System des Wahlleiters geschickt werden. Sofern technische Gruende dies verhindern (z.B. ISDN-only Nodes) muss eine andere Zustellungsweise zuvor zwischen Wahlleiter und dem betreffenden Wahlberechtigten vereinbart werden.
> All votes must be cast at the returning officer's system. Ballot > messages must be sent directly and unrouted to the returning officer's > system. If this is impossible for technical reasons (e.g. ISDN-only > nodes), another means of delivery must be arranged in advance between > the returning officer and the pertinent voter.
Eine Wahlstimme muss folgendes enthalten:
> A ballot must include the following:
- Den Namen des Kandidaten, fuer den gestimmt werden soll (bzw. statt des Namens "Ja" oder "Nein" bei nur einem Kandidaten) oder das Wort "Enthaltung"
> - The name of the candidate to receive the vote (or in case of only one > candidate the choice "Yes" or "No" instead of the name) or the word > "Abstain".
- Ein Passwort, das bei Veroeffentlichung des Wahlergebnisses eine anonyme Verifizierung aller Stimmen ermoeglicht.

Alles Naehere, insbesondere ein ggf. zur automatischen Auswertung erforderliches spezielles Format der Stimm-Mails, legt der Wahlleiter fest.
> All other details, in particular special ballot formats required for > automatic evaluation, are stipulated by the returning officer.
10.3.6. Wahlergebnisse

10.3.6.1 Veroeffentlichung des Wahlergebnisses
> 10.3.6.1 Publication of election results
Das Wahlergebnis wird binnen 3 Tagen nach Ende des Abstimmungszeitraumes vom Wahlleiter veroeffentlicht, nachdem der Kontrolleur das Ergebnis ueberprueft und bestaetigt hat.
> The returning officer will publish the election results - after they > have been checked and validated by the election supervisor - within > three days after conclusion of the voting period.
Sollte es in dieser Zeit nicht moeglich sein, zu einem eindeutigen Ergebnis zu kommen, so muss der RC ueber die Gruende der Verzoegerung informiert und von ihm die Genehmigung zur Ueberschreitung dieser Frist eingeholt werden.
> If it is impossible to arrive at an unequivocal result during this > period, the RC must be informed of the reasons for the delay and his/her > permission obtained to extend the deadline.
Spaetestens 2 Wochen nach Ende des Abstimmungszeitraumes muss ein offiziell gueltiges Ergebnis durch Wahlleiter und Kontrolleur vorgelegt werden, ansonsten ist die Wahl ungueltig und muss komplett wiederholt werden.
> Official election results must be presented by the returning officer and > election supervisor at the latest two weeks after conclusion of the > voting period; the election is otherwise invalid and must be repeated in > its entirety.
Verzoegert ein Wahlleiter oder ein Wahlkontrolleur vorsaetzlich die Veroeffent- lichung des Wahlergebnisses, so kann dies als XAB betrachtet werden.
> It may be considered XAB if a returning officer or election supervisor > intentionally delays publication of the election results.
Die genaue Form der Veroeffentlichung liegt in der Verantwortlichkeit des Wahlleiters; es muss eindeutig ersichtlich sein, welche Stimmen (durch das dazugehoerigen Passwort) auf die einzelnen Kandidaten und die Moeglichkeit "Enthaltung" entfallen sind. Ausserdem muss eine Liste aller Nodes veroeffentlicht werden, die abgestimmt haben.
> The returning officer is responsible for determining the specific form > in which the results are published; which votes were cast for each > candidate and for abstention must be clearly evident (password control). > A list of all nodes who cast a vote must also be published.
Aus der Veroeffentlichung selbst darf kein Rueckschluss moeglich sein, wie ein bestimmter Node abgestimmt hat.
> The published results themselves must not permit conclusions to be drawn > as to how a specific node voted.
Das Ergebnis muss im Node-Echo des Netzes veroeffentlicht werden. Darueberhinaus sind alle Kandidaten und Wahlberechtigten per NM vom Ergebnis zu unterrichten.
> The results must be published in the node echo of the net. All > candidates and the electorate must also be informed of the results by > netmail.
Kein Node darf wegen seiner Stimmabgabe oder wegen Nichtwahl benachteiligt werden.
> No node may suffer a disadvantage because of his/her vote or abstention > from voting.
10.3.6.2 Ergebnis des ersten Wahlgangs / Wahlwiederholung
> 10.3.6.2 Results of the first ballot / rerunning the election
Im ersten Wahlgang ist die absolute Mehrheit der abgegebenen Stimmen fuer den Wahlsieg erforderlich (ueber 50 % der abgegebenen Stimmen).
> On the first ballot, the absolute majority of votes cast (more than 50% > of total votes) is required for an election victory.
Sollte keiner der Kandidaten die absolute Mehrheit im ersten Wahlgang erreichen, so findet ein zweiter Wahlgang (vgl. 10.3.7) oder eine komplette Wiederholung der Wahl (vgl. 10.3.4.2) statt.
> A second ballot (cf. Section 10.3.7) or complete election rerun (cf. > Section 10.3.4.2) is required if none of the candidates achieves an > absolute majority on the first ballot.
Der Wahlleiter teilt dem RC24 nach Abschluss des ersten Wahlgangs das Ergebnis und die daraus evt. resultierenden Konsequenzen mit.
> After conclusion of the first ballot, the returning officer informs RC24 > of the election results and possible resultant consequences.
10.3.7. Zweiter Wahlgang / Stichwahlen

10.3.7.1 Ablauf des zweiten Wahlgangs
> 10.3.7.1 Second ballot procedure
Diejenigen Kandidaten, die die besten beiden Ergebnisse im ersten Wahlgang erzielt haben, nehmen am zweiten Wahlgang teil.
> The candidates achieving the two best results on the first ballot will > run against each other on the second ballot.
Der Wahlleiter benennt direkt im Anschluss an die Veroeffentlichung des Ergebnisses des ersten Wahlgangs diejenigen Kandidaten, die den zweiten Wahlgang bestreiten. Dies geschieht per Netmail an die Kandidaten und alle Stimmberechtigten sowie per Echomail im Node-Echo.
> The returning officer names the candidates for the second ballot > immediately after publication of the first ballot results. All > candidates and all franchised nodes are informed by netmail, and the > information also published in the nodes echo.
Der zweite Wahlgang beginnt ohne erneute Vorstellung der Kandidaten und Diskussion (vgl. 10.3.5) innerhalb einer Woche und dauert zwei Wochen.
> The second ballot commences without reapeated presentation of candidates > or discussion (cf. Section 10.3.5) within one week, and lasts two weeks.
10.3.7.2 Ergebnis des zweiten Wahlgangs / Stichwahl
> 10.3.7.2 Results of second ballot / runoff election
Beim zweiten Wahlgang ist gewaehlt, wer die einfache Mehrheit der abgegebenen Stimmen erhaelt.
> The candidate receiving a simple majority of votes cast wins on the > second ballot.
Erhaelt die Moeglichkeit "Enthaltung" im zweiten Wahlgang die Mehrheit der abgegebenen Stimmen, so setzt der RC einen NC nach seiner Wahl aus den Nodes des betreffenden Netzes ein (10.3.4.2).
> If the majority of votes cast on the second ballot are abstentions, the > RC appoints an NC of his/her choice from the nodes of the pertinent net > (Section 10.3.4.2).
Liegen mehrere Kandidaten mit der gleichen Stimmenanzahl auch im zweiten Wahlgang an der Spitze, so findet eine Stichwahl statt (10.3.7.3).
> A runoff election (Section 10.3.7.3) takes place if more than one of the > candidates receives the highest number of votes cast on the second > ballot.
10.3.7.3 Stichwahl
> 10.3.7.3 Runoff election
Eine Stichwahl laeuft formal wie ein 2. Wahlgang ab. (vgl. 10.3.7.1)
> The formal procedure of a runoff election is identical to that of a > second ballot (cf. Section 10.3.7.1).
Bei der Stichwahl ist gewaehlt, wer die einfache Mehrheit der abgegebenen Stimmen erhaelt.
> The candidate receiving a simple majority of votes cast wins the > runoff election.
Erreicht auch bei der Stichwahl keiner der Kandidaten eine Mehrheit, oder erzielt die Moeglichkeit "Enthaltung" die meisten Stimmen, so waehlt der RC einen Node des Netzes aus und setzt ihn als NC ein (vgl. 10.3.4.2).
> If none of the candidates wins a majority even in the runoff election, > or if the majority of votes are abstentions, the RC selects a node from > the net and appoints him/her the new NC (cf. Section 10.3.4.2).
10.3.8 Wartefrist / Amtsuebernahme
> 10.3.8 Waiting period / assumption of office
Steht das endgueltige Wahlergebnis fest, wird der Wahlsieger fuer den Ablauf einer 14-taegigen Wartefrist als temporaerer NC gelistet. In dieser Zeit sind Einsprueche durch die Wahlberechtigten (10.3.9) moeglich.
> When the final election result has been established, the election winner > will be listed as temporary NC for a waiting period of 14 days. > Franchised nodes may file challenges during this period (Section > 10.3.9).
Die 14 Tage koennen vom scheidenden und neuen NC sowie von den Hubs genutzt werden, um die notwendigen Umstellungen vorzunehmen.
> The incumbent NC, NC-elect and the hubs can make use of these 14 days > to make required changes.
In dieser Zeit darf der neu gewaehlte NC ausser dem Zusammenstellen und der Weitergabe des Networkfiles keine weitergehenden Pflichten eines NC uebernehmen, sofern dies nicht technische Probleme zwingend erfordern.
> During this period, the newly elected NC may not assume any > responsibilities of an NC which go beyond compilation and distribution > of the network file unless technical problems absolutely demand action.
Complaints in dieser Wartefrist werden nur in dringenden Faellen direkt vom RC bearbeitet und ansonsten die Bearbeitung verschoben. Ein in dieser Zeit eingereichter Complaint gilt als fristwahrend.
> Complaints filed during this waiting period are only processed in urgent > cases, and then by the RC him/herself; processing of other complaints is > postponed. A complaint filed during this period is considered to have > met applicable deadlines.
10.3.9 Einsprueche gegen die Wahl / Complaints
> 10.3.9 Election challenges / Complaints
Fuer die Bearbeitung von Einspruechen, die in Zusammenhang mit der Wahl stehen (z.B. Einsprueche gegen das Wahlergebnis, die Termine oder den Verlauf der Wahl, die Person oder die Aktivitaeten des Wahlleiters und des Wahlkontrolleurs), ist der RC24 zustaendig.
> The RC24 is responsible for processing election-related objections such > as challenges of the election results, election dates or procedure, the > persons or activities of the returning officer and the election > supervisor.
Einsprueche muessen binnen 14 Tagen nach Bekanntwerden des Einspruchsgrundes per Netmail vorgebracht und begruendet werden.
> Challenges with justification must be filed by netmail within 14 days > after the reason for challenge has become known.
Spaetestens 14 Tage nach Verkuendung des endgueltigen Wahlergebnisses laufen alle Einspruchsfristen ab.
> The period for filing challenges ends at the latest 14 days after > announcement of the final election results.
Die absichtliche Faelschung eines Wahlergebnisses oder von Wahlstimmen wird als XAB betrachtet.
> Deliberate falsification of an election result or of votes will be > considered XAB.
Zustaendig fuer die Bearbeitung eines Complaints ist in diesem Fall der RC24 mit Widerspruchsmoeglichkeit beim ZC2.
> The RC24 is responsible for processing a complaint in this case, and the > judgement may be appealed to the ZC2.
10.3.10 Verfahrensweise bei weniger als 2 Kandidaten
> 10.3.10 Procedure in case two or fewer candidates
Sollte sich nur ein Kandidat finden, nimmt dieser die Position des NC des betreffenden Netzes ein, ausser wenn mindestens 10 % der stimmberechtigten Nodes eine Abstimmung fordern.
> If only one candidate stands for election, he/she will assume the > position of NC of the pertinent net unless at least 10 % of the > franchised nodes demand a vote.
In diesem Fall stellt sich der Kandidat zur Abstimmung mit den Wahlmoeglich- keiten JA und NEIN. Er ist gewaehlt, wenn die Wahlmoeglichkeit JA die Mehrheit der abgegebenen Stimmen erreicht. Erreicht er nicht die erforderlich Mehrheit, so findet eine komplette Neuwahl statt. Steht auch nach dieser Neuwahl der NC nicht fest, setzt der RC24 einen NC seiner Wahl aus den Nodes des Netzes ein.
> In this case, the candidate stands for a vote with the alternatives YES > or NO. He/she is elected if the majority of votes are cast for the > alternative YES. If he/she does not win the required majority, a > completely new election takes place. If even this new election does not > succeed in establishing an NC, the RC24 will appoint an NC of his/her > choice > from the nodes of the net.
Sollten sich keine Kandidaten fuer das Amt eines NC finden, so kann der RC24 entweder einen NC seiner Wahl einsetzen oder das Netz aufloesen.
> If no candidates stand for the office of NC, the RC24 can either appoint > an NC of his/her choice or dissolve the net.
In letzterem Fall wird die Aufteilung des Netzgebietes in Zusammenarbeit zwischen dem RC24 und den NCs der umliegenden Netze vorgenommen.
> In the latter case, the RC24 and the NCs of the surrounding nets will > cooperate in dividing the territory of the net.
10.3.11 Amtsperiode
> 10.3.11 Term of office
Die Amtsperiode eines gewaehlten NC in R24 betraegt maximal 24 Monate, beginnend mit der Verkuendung des Wahlergebnisses.
> The maximum term of office of an elected NC in R24 is 24 months, > beginning with the day the election result is published.
Ein vom RC eingesetzter NC hat eine Amtszeit von maximal 12 Monaten.
> The maximum term of office of an NC who has been appointed by the RC is > 12 months.
Der amtierende NC kann sich wieder fuer die naechste Amtsperiode bewerben, wird aber mit Ablauf seiner Amtszeit so behandelt, als waere er zurueckgetreten.
> The incumbent NC may again run for another term of office, but is > treated as if he had resigned at the end of his/her term.
Der scheidende NC hat kein Recht, seinen Nachfolger zu ernennen.
> The departing NC has no right to name his/her successor.
10.3.12 Abwahl des NC, vorgezogene Neuwahl
> 10.3.12 NC removal by vote, premature elections
Der NC eines Netzes kann jederzeit vor Ende seiner regulaeren Amtszeit abgewaehlt werden.
> The NC of a net can be voted out of office at any time before the regular > end of his/her term.
Abwahlen finden durch komplette vorgezogene Neuwahl eines Nachfolgers gemaess Abschnitt 10.3.1 bis 10.3.11 dieser Policy statt (konstruktive Neuwahl).
> Removal by vote takes place by means of complete premature election of a > successor as described in Sections 10.3.1 to 10.3.11 of this policy > (constructive new election).
Um eine vorgezogene Neuwahl einzuleiten, ist der formlose schriftliche Antrag von 1/3 der stimmberechtigten Nodes des Netzes beim RC erforderlich; die Stimmen koennen auch gesammelt und durch einen Beauftragten der Nodes beim RC komplett abgegeben werden. Darueber hinaus muss zusaetzlich mindestens ein Kandidat benannt werden, der verbindlich bereit ist, sich zur Wahl als NC zu stellen.
> An informal written motion by one-third of all franchised nodes in the > net to the RC is required to initiate a premature election; the votes > may also be collected and forwarded to the RC as a block by a > representative of the nodes. In addition, at least one node definitely > willing to stand as an NC candidate in the election must be named.
Vorzeitige Neuwahlen werden auch bei Amtsenthebung des NC wegen Nichterfuellung der Amtspflichten oder bei vorzeitiger Amtsaufgabe des NC faellig.
> Premature elections are also necessary if the NC is removed from > office because of dereliction of official duties or in case of > his/her resignation.
Bei der vorgezogenen Neuwahl kann der momentane Amtsinhaber ebenfalls kandidieren.
> The incumbent officeholder may similarly stand as a candidate in the > premature election.
Solange die vorgezogene Neuwahl nicht abgeschlossen ist, darf der amtierende NC keine Aktivitaeten unternehmen, die die Wahl in irgendeiner Weise behindern. Er darf keine nur schwer rueckgaengig zu machenden Fakten schaffen. Saemtliche von ihm durchgefuehrten Aktivitaeten waehrend der vorgezogenen Neuwahl sind bis zu deren Abschluss als vorlaeufig zu betrachten.
> The incumbent NC may not undertake any activities that could impede the > election in any manner during the time the premature election is in > progress. He/she may not make decisions which could only be reversed > with difficulty. Each and every activity he/she performs during the > premature election is to be considered provisional prior to completion > of the election.
10.3.13 Ergaenzungen/Besonderheiten
> 10.3.13 Supplementary remarks / special cases
Lokale Policies auf Network-Ebene (Network-Policies) koennen die Regelungen dieser RegPol ergaenzen, Rechte fuer Nodes erweitern und in einzelnen Punkten auf lokale Besonderheiten oder Wuensche Ruecksicht nehmen. Dabei duerfen aber die in dieser Region-Policy festgelegten Rechte der Nodes nicht eingeschraenkt werden.
> Local policies at the net level (network policies) may supplement the > rules of this RegPol, extend the rights of the nodes and make allowances > for local conditions or wishes in certain points. However, the node > rights established in this regional policy may not be abridged.
Network-Policies muessen vom RC24 genehmigt werden. Bei Ablehnung durch den RC ist die Genehmigung einer Network-Policy dennoch moeglich, wenn dies der NCC mit der absoluten Mehrheit seiner stimmberechtigten Mitglieder beschliesst.
